Privacy Policy
The purpose of this Information Notice is to inform the user ("Interested Party") about the methods of processing personal data concerning him/her. With this policy the Owner intends to guarantee the privacy and security of the personal data of each interested party, in accordance with the provisions of Legislative Decree no. 196/2003 (hereinafter "Privacy Code") and with EU Regulation no. 2016/679 (hereinafter "GDPR").
Owner and data processors
The personal data of the interested party are processed by Esportseries.net as Data Controller. More detailed information on the names of the Data Processors may be requested by sending an e-mail to the following address: info@esportseries.net.
Types of data processed
The Data Controller acquires and processes the personal data of the data subject through the following methods:
Navigation data: during online navigation, through the computer systems and software procedures used to operate the website, the Owner acquires some data whose transmission is implicit in the use of Internet communication protocols, such as: IP addresses, domain names of computers used by the person concerned, addresses in URI (Uniform Resource Identifier) notation, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response from the server (successful, error, etc.. ), the country of origin, the characteristics of the browser and operating system used by the visitor, the various temporal connotations of the visit (e.g. the time spent on each page) and details of the itinerary followed within the Application, with particular reference to the sequence of pages consulted, the parameters relating to the operating system and the computer environment of the person concerned.
- Other categories of data: this refers to all the personal data provided by the interested party at the time of registration and/or access to a reserved area and in any case to the services offered under subscription by the Owner, alone or in partnership with third parties.
Contact management and message sending: this type of service allows you to manage a database of email contacts, telephone contacts or contacts of any other type, used to communicate with the User. These services may also allow you to collect data relating to the date and time the User displays messages.
Donations management: Donations management services allow you to process donations via credit card, paypal or other tools. The data used for payment is acquired directly by the manager of the requested donation service without being processed in any way by Esportseries.net. Some of these services may also allow the scheduled sending of messages to the User, such as emails containing invoices or notifications regarding donations.
- Paypal (Paypal, Inc.): PayPal is a payment service provided by PayPal, Inc. that allows the User to make online donations. Personal Data Collected: Various types of Data as specified in the privacy policy of the service.
Purposes and methods of treatment
The personal data collected by the Owner for the purposes of the conclusion or execution of existing contracts will be processed lawfully in accordance with art. 6 of GDPR for the following processing purposes:
- To provide the service and/or the goods requested by the data subject. Personal data processed by the Data Controller may include: name and surname, company name, name and surname of the legal representative or of the person in charge, address of residence and/or domicile and/or registered office, email address, telephone number, as well as all personal information provided to the Data Controller by the data subject at the time of signing or during the negotiation relationship.
- Send advertising, promotional and/or commercial material and, in general, marketing communications in the interest of the Owner. The personal data of the interested party (name and surname, company name, name and surname of the legal representative or of the person in charge, address of residence and/or domicile and/or registered office, email address, telephone number) will be processed by the owner for these purposes with free and optional consent, except for promotional and/or commercial communications regarding services and/or products already subscribed and/or purchased by the interested party, for which the processing is based on a legitimate interest of the Owner (e.g. sending newsletters and/or promotions regarding services already subscribed). The consent may be revoked at any time.
- To gather experience in the use of the platforms, products and services offered by the Owner. The processing of personal data for these purposes (name and surname, company name, name and surname of the legal representative or of the person in charge, address of residence and/or domicile and/or registered office, email address, telephone number) will be carried out by the owner with the free and optional consent of the person concerned. The consent may be revoked at any time.
- Monitor the navigation data of the interested party. The consent to the processing of data for these purposes, free and optional, is given by the person concerned through the simplified method and described in the information that appears at the time of access on the website.
- Allow third parties to carry out profiling activities in aggregate and anonymous form, i.e. analysis and processing of information relating to website users, their preferences, habits, consumption choices and/or browsing experiences, through the processing of the following data: IP addresses, the type of browser used, the operating system, the domain name and addresses of websites from which access has been made, information on the pages visited by users within the site, the time of access, the permanence on the single page, the internal path analysis and other parameters related to the operating system and the user's computer environment. The processing of personal data for these purposes is carried out only and exclusively by third parties who have commercial relations with the Owner, through the use of technologies such as cookies and in the manner described in the following paragraph "Cookie Policy".
Scope of dissemination of data
Subject to free and optional consent, the data of the interested party may be communicated to third party companies with which the Owner has concluded or may conclude partnership agreements such as, by way of example: social networking and interactive platforms, consumer goods, distribution, publishing, financial, insurance, humanitarian and charitable organizations, telecommunications companies or having further and different commercial and/or industrial purposes.
Your personal data may be disclosed to third parties in their capacity as "External Data Processors", such as, by way of example, service providers (administrative and IT services, third party technical service providers, postal carriers, hosting providers, IT companies, communication agencies, etc.), consultants of the Data Controller (accountants, auditing firms, lawyers, etc.), banks and financial institutions, authorities and public bodies. In addition, employees and/or collaborators of the Owner who are in charge of managing the contractual relationships may become aware of your data. These subjects are formally appointed by the Data Controller to process personal data exclusively for the purposes indicated in this information notice and in compliance with regulatory provisions. The data subject has the right to obtain a list of any data processors appointed by the Data Controller, by making a request to the Data Controller in the manner indicated in the following paragraph "data subjects' rights".
Transfer of data outside the EU
The data controller may transfer the personal data of the data subject to third parties established in countries outside the EU. Should this circumstance occur, the Data Controller shall ensure the adoption of adequate guarantees with the foreign companies receiving the data in accordance with the provisions of Chapter V of the GDPR.
Redirect to external websites
The website can use the so-called social plug-ins. Social plug-ins are tools that allow you to incorporate social networking features directly into your website (e.g. Facebook's "like" function). All social plug-ins on the website are marked with the respective logo of the social networking platform (e.g. Facebook, Google, Twitter, Linkedin). When you visit a page on the website and interact with the plug-in (e.g. by clicking on the "Like" button) or leave a comment, the corresponding information is transmitted directly from your browser to the social networking platform and stored there. For information on the purposes, type and methods of collection, processing, use and storage of personal data by the social networking platform, as well as how to exercise your rights, please refer to the privacy policy adopted by the individual social network concerned. The Owner declines any responsibility regarding the possible request and/or release of personal data to third party sites and/or regarding the management of authentication credentials provided by third parties.
Data retention
The personal data of the data subject will be retained for a period equal to the duration of the existing contractual relationship with the Data Controller. Moreover, the data will be kept for the period of time strictly necessary to allow the Owner to fulfil the legal, administrative, fiscal, tax obligations, as well as for the time strictly necessary to allow the Owner to exercise the right of defence in court.
Rights of the interested parties
Interested parties may exercise the following rights recognised by the Privacy Code and by GDPR with regard to the personal data processing activities carried out by the Data Controller:
- access: the interested party may ask for information on the existence or not of a processing in place at the Data Controller, as well as further clarifications regarding the information referred to in this Policy within the limits of reasonableness and collectability, as well as to receive the data themselves;
- rectification: the data subject may ask to rectify or supplement the data provided or in any case in the possession of the Data Controller, should these be inaccurate;
- deletion (oblìo): the data subject may request the deletion of the data acquired and processed by the Data Controller, if they are no longer necessary for the purposes described in paragraph 4 ("purposes and methods of processing"), provided that there are no objections or disputes with the Data Controller, or in cases of revocation of consent, opposition to processing, unlawful processing, or where there is an obligation to delete them;
- the limitation: the interested party may request the limitation of the processing of his/her personal data where one of the conditions provided for in art. 18 of the GDPR and with the exception of what is stated in paragraph 2 of the same article.
- opposition: the interested party may object to the processing of his/her data at any time, unless there are legitimate reasons that allow the Data Controller to proceed with the processing, such as, for example, the need for out-of-court or judicial defence. If, for technical reasons, following the exercise of the right to object, the interested party continues to receive further promotional messages after 24 hours have elapsed from the request to exercise the right to object, the same may report the problem to the Owner using the contacts indicated at the bottom of this article.
- portability: the data subject may request to receive personal data concerning him/her, or request its transmission to another data controller in a structured, commonly used and machine-readable format.
- the revocation of consent: the interested party may at any time exercise the right to revoke consent, pursuant to art. 7, paragraph 3, GDPR, without prejudice to the lawfulness of the processing activities already carried out on the basis of the consent previously given.
- the right to lodge a complaint: the data subject may take action before the Control Authority where he or she habitually resides, where he or she works, or before the competent authority in relation to the place where the alleged violation has occurred. For the territory of the Italian State, the competent Authority is the Guarantor for the Protection of Personal Data, based in Piazza di Monte Citorio n. 121, 00186 - Rome (http://www.garanteprivacy.it/).
In order to exercise rights, report problems or ask for clarifications on the processing of his/her personal data, the interested party may forward his/her requests by registered mail, writing to the Data Controller - Esportseries.net, or sending an e-mail to the e-mail address info@esportseries.net specifying the subject of the request.
The exercise of the aforementioned rights by the interested party is free of charge, except that, pursuant to art. 12, paragraphs 3 and 5, GDPR, having assessed the complexity of the activities to be carried out in response to the request, the Data Controller may request a contribution from the interested party, taking into account the costs incurred and/or to be incurred. The Owner will have 30 days to respond to the request of the interested party.
Changes to the information
The possible and subsequent entry into force of new regulations in the sector as well as the constant examination and updating of services may determine the need to change the methods and terms described in this Information Notice. It is therefore possible that this document may change over time. The owner will publish any changes to this Policy on this page and, if the changes are relevant, will notify them through a more visible notification. Previous versions of this Policy will in any case be stored and archived.
